Terms & Conditions
Each bridal party booking the services of Nicky Sparks’ Wedding Hair & Make-up are required to read the full terms & conditions below. You are required to sign & date a copy, and send, along with a completed booking form and a deposit to book your date.
Deposit & Booking Form
A completed booking form and a signed copy of the terms & conditions must be received along with a £50 deposit before I can guarantee your booking for you. You can either print it off the website, I can email it to you or I can post it to you. Until I have received these I cannot guarantee your booking. I will only work with one bridal party on any one day, so will not accept bookings for a day that is already booked.
Additions to Booking Form
If there are any additions to be made to the booking form, due to extra people requiring my services I would need to be advised no later than the day of the trial. I will amend the booking form then or you can have a new copy with the new charges on it.
My contract is with the bride. If the other members of the bridal party are paying for their hair & beauty themselves, then the bride is required to collect their payments from them. I am not responsible for collecting separate payments from different members of the wedding party.
Trials
A mutually convenient time for the trial will be arranged for approximately 6-8 weeks before the wedding day unless agreed otherwise.
On the day of the trial I will try different hairstyles/ make-up looks until you are completely happy. (There is a maximum of three hairstyles & make-up looks per trial)
All members of the Bridal Party requiring Hair &/or Make-up must have a trial, unless I have agreed otherwise. If members of the bridal party do not attend a trial there may be a surcharge payable, and a disclaimer signed. (At my discretion)
Mileage
All bookings are subject to mileage charges if they are over the fifteen mile radius from postcode DA12 3EA. This also includes trials. Once the distance has gone over the fifteen-mile limit, each mile will be charged at £1.50 per mile thereafter.
Payment
Once the trial is completed the total balance is payable in the form of either a cheque or cash or six weeks before the wedding date, whichever comes first. Any late bookings have to be paid in full by cash at the trial.
Any additional extra’s i.e. make-up for touch-up’s, hairpieces etc will be invoiced separately.
Cancellations made by you
Cancellations made by you prior to your trial will result in the loss of your deposit. Cancellations by you made less than four weeks before the date of your wedding will incur a 70% charge of the final balance.
If after the trial you decide not to use my services you are still required to pay the trial balance in full and are required to inform me up to a maximum of one week after your trial date if you no longer require my services on your actual wedding day.
NB. Failure to do so may result in further charges.
Cancellations made by Nicky Sparks
In the event that I am unable to make the booking due to illness or any personal emergency, I will try to find you a replacement make-up artist or hair designer that I would highly recommend. Cancellation by myself prior to your trial will result in your deposit refunded in full. Cancellation by me prior to your wedding day, but after your trial, will result in a full refund of your deposit & 50% of the trial costs refunded.
In the event of an accident or severe illness, inclement weather conditions/act of god affect myself getting to you on the actual wedding day I will try & find you replacement artist/artists to look after your needs. I cannot be held responsible for any mechanical breakdowns, or for any delays caused by events beyond my control. In the event that I cannot find anyone else available that I would recommend, then the full extent of my liabilities’ would be to give you a full refund. Please Note: I reserve the right to cancel your booking without refund, if at any time during the trial any member of your bridal becomes abusive or violent or displays any behavior that I feel offensive.
Liability and Indemnification
(a) Limitation of Liability:
I, Nicky Sparks, am neither an insurer nor a guarantor and disclaim all liability in such capacity. Clients seeking a guarantee against cancellation, loss or damage should obtain appropriate insurance.
Services are conducted on the basis of information, documents and/or samples provided by, or on behalf of, The Client and solely for the benefit of The Client. Neither any employees, nor myself, agents or subcontractors shall be liable to the Client nor any third party for any actions taken or not taken outside the remit of the service supplied nor for any problems arising from unclear, erroneous, incomplete, misleading or false information provided to the myself.
I, Nicky Sparks, shall not be liable for any delayed, partial or total non-performance of the services arising directly or indirectly from any event outside my control including failure by the Client to comply with any of their obligations.
My liability in respect of any claim for loss, damage or expense of any nature and howsoever arising shall in no circumstances exceed the costs of services contracted to provide.
If any one or more provisions of these General Conditions are found to be illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
Date Changes
If your circumstances change for any reason and you then wish to change the date booked for your wedding, I require a minimum of three months notice in writing. I cannot guarantee being able to cover your wedding until I have confirmed it with you in writing via email or by post, as I may have other commitments. Your deposit will be non-refundable if this is the case.
Photographs
Photographs will be taken during your trial and also on your wedding day. These photographs may be used in my portfolio of work and also on my website. Please contact me if you do not wish to have your photos displayed on the website or in my portfolio.
Please note: Names & personal details are never disclosed or displayed.
I __________________ have read, understood and am in full agreement with the terms and conditions set out by Nicky Sparks. It is my full responsibility to make sure that all members of my Bridal party abide by the terms and conditions set out above. I understand that the terms and conditions are in the interest of both Nicky Sparks and myself. I have signed and returned one copy to Nicky Sparks, as well as kept one copy for myself.
